Rule 161
Motion of impeachment against the head or member of the constitutional body
(1) The grounds and reasons for submitting a motion for impeachment against the office bearer as per sub-section (2) of Article 101 of the Constitution shall be given to the Secretary General or, in his absence, to the Secretary General. Explanation :- For the purpose of this paragraph, "Officer" means the Chief Justice or Supreme Court Judge of Nepal, member of the Judicial Council, head or official of the constitutional body.
(2) Upon receipt of the resolution as per sub-rule (1), the Secretary General or in his absence, the Secretary shall submit it to the Speaker. The speaker will fix the day and time for discussion in a meeting seven days after the date of registration of such proposal.
(3) In the event that the session of the House of Representatives is not in progress, the member who submits the proposal according to sub-rule (1) shall demand that the meeting be held within fifteen days at the most from the date of registration of such proposal, as well as call for the session in accordance with sub-section (3) of Article 93 of the Constitution.
(4) In the event that a session is convened according to sub-rule (3), a date and time shall be set so that the impeachment motion is discussed at a meeting within three days of the commencement of such session.
(5) On the day and time specified in accordance with sub-rule (2) or (4), after the name is called by the speaker, the proposing member shall present the motion of impeachment in the meeting and if he wishes, he may make a statement before presenting the motion.
(6) After the submission of a proposal in accordance with sub-rule (5), the Speaker shall determine the time period for discussion on the proposal and after the conclusion of the discussion, the Speaker shall send such proposal to the impeachment recommendation committee as per Rule 161.
(7) At least three members certify that the information, information or complaint received on the basis that the person to be removed from office by impeachment in accordance with sub-rule (1) has seriously violated the constitution or has lacked efficiency or bad conduct or has not faithfully complied with official obligations or has seriously violated the code of conduct is admissible by at least three members If it is submitted, the General Prosecution Recommendation Committee according to Rule 162, such complaintIf it is investigated and recommended to the Assembly for impeachment-related action, an impeachment proposal can be submitted.
(8) In accordance with sub-rule (7), the committee may submit a recommendation for impeachment if the relevant person is likely to be impeached during the preliminary investigation and if sufficient grounds are found. When the recommendation presented in this way is submitted for decision in the meeting, if it is supported by a quarter of the total number of members in the House of Representatives, the process of impeachment will begin.
(9) After the initiation of impeachment proceedings in accordance with sub-rules (1) and (8), the accused official shall not be entitled to perform the duties of his office until such proceedings are concluded.
